Electronic Resources Copyright Warning


IMPORTANT!
Misuse of e-resources and/or violation of the agreements may result in the suspension or termination of access to Library-subscribed electronic resource from the entire University community!



The use of Library-subscribed electronic resources is governed by license agreements negotiated between the University Library and publishers/vendors. It is important that our users abide by the terms of the contracts/agreements so that the HKBU community can enjoy convenient access to the electronic resources subscribed by the Library without interruption. We request that you familiarize yourself with the responsibilities of using electronic resources as shown below.


Authorized Users
  • The electronic resources are only provided for current HKBU Community.
Copyright
  • The entire contents of the journals/databases/e-books/multimedia materials are protected by copyright of the publishers/vendors.
  • Users are warned that they are fully responsible for any legal consequences arising from infringement of applicable copyright laws.
Appropriate Use
  • In compliance with the copyright regulations, users may download, save or print reasonable portion of text, search results, or other information from these resources solely for studying, teaching, or research purposes.
  • Use of materials for commercial purposes is prohibited.
  • Do not share your access password with unauthorized users.
  • Do not copy and use licensed materials without proper attribution.
Excessive/Systematic Downloading
  • Systematic or programmatic downloading/copying, archiving of an "excessive" portion of a resource in any form or medium is strictly prohibited. Examples:

  • -  Continuously download one article after another;
    -  Continuously download table of content, search results, citations or output after
       another;
    -  Download the entire issue of an e-journal after another;
    -  Download the complete run of an e-journal;
    -  Download the entire content of e-books or multimedia.
  • Archiving of downloaded materials on local servers outside vendor /publisher’s control without permission is prohibited.
Redistribution of Information
  • Reselling, redistributing or reproduction of any journal text, output, search results, or other information in any form or medium is strictly prohibited.
  • Posting materials retrieved or downloaded to a listserv, on a website or to an email list is prohibited.
  • Redistribution of materials to non-subscribers or to non-subscribing institutions is prohibited.
Consequences in case of Violation
  • Vendor/publisher may monitor use of electronic resources and track the account activity. If the account activity is unusual, the vendor will trace the source of misuse activity.
  • The vendor/publisher may ask the Library to warn the user of this source machine, or even terminate access to the particular electronic resource from the entire University community.
  • Users are fully responsible for the consequences of violation because various legal and monetary penalties may be invoked by publishers/vendors. The Library may also suspend the violators access to our subscribed electronic resources.

Audio-Visual Materials Copyright Information

The following information serves as a reference guideline only.

Audio-visual materials mentioned here include sound recordings, video recordings, films, and broadcast or cable programs of the Library.

For Private Study & Research
  • In accordance with Section 38 of the Copyright Ordinance, individuals may use copyright works, including but not limited to AV items, to a reasonable extent, for private study or research.
For Teaching & Learning
  • Teachers and students are permitted to play or show an AV item borrowed from the library, including but not limited to recorded broadcast programmes, for the purpose of giving or receiving instruction.
For Web Teaching & Learning
  • Teachers and students can upload a reasonable portion of copyright work, including but not limited to AV items, on the university intranet for the purpose of giving or receiving instruction if:

  • -  all criteria for fair dealing are met;
    -  security measures (e.g., login username and password) are adopted;
    -  access is restricted to users in a specified course of study; and
    -  the uploading duration does not exceed 12 consecutive months.
For School Performances
  • The playing or performing of a dramatic or musical work by teachers, students, or any other person in a school performance is permitted, if:

  • -  the activity takes place within the university premises; and
    -  the activity is not open to the general public.

What is "Fair Dealing"?

Section 41A of the Copyright Ordinance provides a "fair dealing" provision that allows teachers and students to use or deal with reasonable portions of copyright works in a fair manner for teaching and learning in a specified course of study.

To decide whether an act of dealing with a copyright work is "fair", we need to consider all the circumstances, in particular:

  • the purpose and nature of the dealing, including whether such dealing is for non profit-making purpose and whether it is of a commercial value;
  • the nature of the work;
  • the amount and substantiality of the portion dealt with in relation to the work as a whole; and
  • the effect of the dealing on the potential market for or value of the work.
