Terms and Conditions on Intellectual Property Rights and

Collection and Use of Personal Information

A)    General

  1. The HKBU 70th Anniversary Logo and Slogan Design Competition (“Competition”) is hosted by Hong Kong Baptist University (“HKBU”).
  2. Participation in the Competition and/or submission of any Competition entry to HKBU shall constitute unconditional agreement of the participants of the Competition (“Participants”) to be bound by all the terms and conditions set out herein (collectively, “these Terms and Conditions”).
  3. The Participants shall comply with HKBU’s prescribed rules of the Competition, all these Terms and Conditions and all applicable laws, rules and regulations. In the event of any breach thereof by a Participant, HKBU reserves the right to disqualify his/her participation from the Competition, exclude his/her Competition entry at any time and/or revoke his/her qualification for the prize or award.
  4. The Participants shall not engage in any plagiaristic behaviour, or submit any designs and/or slogans which contain inappropriate content or elements (including but not limited to violent, pornographic, defamatory, indecent, illegal, discriminatory and/or immoral elements) or which infringes the rights of any entity. 
  5. HKBU assumes no responsibility or liability to any Participant(s) or third party for any submitted entries and/or designs.  Each Participant agrees to be liable for and to indemnify HKBU, its employees, supporting entities for the Competition and related parties against any and all losses, costs, liabilities and claims arising out of or in connection with the Participant’s submitted designs or slogans and/or violation of these Terms and Conditions. 
  6. HKBU has the sole and absolute discretion to (a) select winner(s) of the Competition; (b) terminate or disqualify any Participant’s entry for the Competition in circumstances that HKBU deems appropriate; (c) amend the Competition rules and/or these Terms and Conditions; and (d) cancel or postpone the Competition.  The decisions of HKBU in all matters relating to this Competition, including whether the winning submission shall be adopted as HKBU’s 70th anniversary logo and/or slogan, are final.  In the event of any dispute relating to the Competition and/or these Terms and Conditions, HKBU shall have the right to make the final decision.   
  7. Any waiver of any provisions hereof may only be made by HKBU in writing.  If any provision hereof is held by any court of competent jurisdiction to be illegal, invalid or unenforceable, the remaining provisions hereof shall remain in full force and effect.
  8. These Terms and Conditions and all matters relating to the Competition are governed by and shall be construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). Each Participant irrevocably submits to the exclusive jurisdiction of the courts of Hong Kong to resolve any claim or dispute in connection with these Terms and Conditions and/or the Competition. 
  9. In case of any discrepancy between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.

 

B)    Intellectual Property Rights

  1. Each Participant agrees and warrants that (a) all submitted entries and designs must be the original works of the Participant and do not infringe the rights of any person or entity; (b) the Participant is the sole owner of the entire copyrights and all other intellectual property in the submitted entries and designs; (c) all the submitted entries and designs have not been submitted for any other competition(s) or provided to any party for any purpose other than submission to HKBU in the Competition; (d) no third party has any right, title, claim or interest in the submitted entries and designs or any part(s) thereof. Any violation of this paragraph may lead to revocation of any awards or prizes given.
  2. Each Participant agrees and accepts that upon his/her submission of any entries, designs and/or slogans to HKBU, (a) the Participant shall be deemed to have assigned any and all the intellectual property rights (including but not limited to copyrights) of, and all rights, title and interest in, the designs and slogans to HKBU absolutely; (b) the Participant shall be deemed to have irrevocably waived all moral rights (whether past, present or future) in respect of the designs and slogans; (c) all intellectual property rights of and in the designs and slogans become vested solely and exclusively in HKBU; and (d) HKBU has perpetual, royalty-free, unlimited, unconditional, worldwide and irrevocable rights to use, edit, modify, translate, adapt, distribute, copy, disseminate, exhibit, display, publish, promote and/or reproduce the designs and/or slogans (and the title and descriptions thereof) submitted in the Competition, without notice to or consent of the Participants and without obligation to make any payment. The Participants shall have no rights, title or interest in the submitted designs and/or slogans. The Participants agree that HKBU has the right to use, display and/or publish the submitted designs and slogans (and the title and descriptions thereof) for any purposes including but not limited to (i) printed publication; (ii) online publication; and (iii) promotion of HKBU in any media and channels including, but not limited to, reports, publicity materials, exhibitions, websites and/or social media platforms.
  3. All Participants agree not to copy, duplicate, display, distribute, disseminate, sell, disclose or publish the submitted designs and/or slogans in any circumstances without obtaining prior written approval of HKBU.  All submitted designs will not be returned to the Participants.
  4. HKBU reserves the right to modify, use and exhibit all Competition entries for the purpose of celebrating its 70th anniversary.
  5. The Participants shall be solely liable for any breach of intellectual property rights in respect of their submitted designs and/or slogans, and shall indemnify HKBU, its employees and other concerned parties against any and all direct, indirect and/or associated claims, losses and liabilities arising from or in connection with any such breach including the financial losses.
  6. If a Participant has disposed of any rights, title or interests of the submitted designs and/or slogans to a third party, such as by assignment, transfer or provision as security, or proceeds with application or registration procedures, etc. for all or any part of the intellectual property rights or any other rights in respect of the submitted designs and/or slogans, the submission shall be invalid.
  7. The winning designs and slogans are subject to investigations regarding originality and eligibility for trademark registration. If they do not comply with the investigation requirements, HKBU has the sole discretion to forfeit the prizes and/or revoke the awards without incurring any liability, and other entries may be selected as the winning designs and/or slogans.

 

C)    Collection and Use of Personal Information

  1. Each Participant acknowledges and agrees that any personal information collected by HKBU, and the photographs and videos taken in relation to the Competition, will be used for communication, selection, results announcement, administration, record, promotion and statistical purposes and other relevant purposes with regard to the Competition.  If required, the personal data so collected may be transferred to third-party service providers which provide support services to HKBU for the purposes stated above.  The provision of personal data is voluntary.  If a Participant does not provide sufficient personal data, he/she may not be able to enrol in this Competition.  All personal data provided must be genuine and accurate.  The personal data shall be collected and used in accordance with the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong) and HKBU’s Privacy Policy Statement and Personal Information Collection Statement (please click here) as amended from time to time.  The Participants have the right to request access to and correction of their personal data.  Enquiries concerning the personal data provided, including the request for access and correction, shall be addressed to the Departmental Personal Data Privacy Manager of the Communication and Public Relations Office, Hong Kong Baptist University, Kowloon Tong, Kowloon, Hong Kong (email address: data-privacy@hkbu.edu.hk).
